CITY OF FERNDALE OFFICIAL NOTICE WEED CONTROL REGULATIONS Chapter 20 Article III, Section 20-38 to 20-44 of the City of Ferndale Code of Ordinances makes it the responsibility of each occupant and/or property owner to keep and maintain his/her property including the space between the sidewalk and the curb and the alley adjoining his/her property, if any, free of tall weeds, grass or other vegetation greater than seven inches in height or spread from May 1 to October 31; failure to do so shall make the occupant and/or property owner subject to the penalty provisions of this Ordinance. The City Manager shall give notice once each year prior to May 1 by publishing at least two times in a newspaper having general circulation within the City and by such other means as the City Council shall direct; said notice shall declare the provisions of this article and the penalties for the failure of compliance. If the owner and/or occupant does not cut or remove such weeds or grass within 5 days from the date of notice and maintain the property free from such vegetation from May 1 until October 31, the City may enter upon such property WITHOUT FURTHER NOTICE and cut and remove such vegetation with all the costs, including inspection fees and related processing fees billed at $275 for the first hour charged to the property owner which may be added to, and collected with the taxes if not paid when due. While this Ordinance is primarily aimed at vacant property, it will be enforced on all properties within the City of Ferndale. The City urges all residents, business and commercial property owners to maintain their properties free of tall weeds or grass or other harmful vegetation from May 1 to October 31 each year. The owner and/or occupant of property in violation of this Ordinance may receive an initial notice to remedy said violation. The ordinance provides that once the property owner has been notified by official legal notice as provided above, the City may enter upon the property, WITHOUT FURTHER NOTICE and perform the necessary mowing and cleanup work.
