A private tennis court located on a residential lot may include a chain link fence enclosing each end of the court and extending toward the net no farther than the midpoint between the base line and service line. The chain link fence may have a maximum height of 12 feet, and the opacity of such fence shall not exceed 50 percent. Further section 1268.28 (b) (4) Height. … As used in this section, the height of a fence is measured from the surrounding surface and not from any structure or localized raised surface on which the fence is situated. Further, the fence area above is requested to be glass for use as part of the padel ball function. The fence request is for a padel ball court, which has been administratively interpreted as being the same as a tennis court or sports court. By using the description herein, the area adjacent to the court will be raised 1’-3” to install a retaining wall to create a sunken court. The court end of the fence is to be 12 feet in height on a raised retaining wall and returns part way towards the center of the court equal to what would be as defined above. The part that would require an additional variance would be to enclose both sides and have a small opening for ingress/egress to the court. This fence is proposed to be 8’-6” in height as shown in the exhibit provided. Therefore, the applicant is requesting the following two variances: 1.) Request a variance to allow for a raised area of 1’-3” to install a fence of 12’ in height in violation of section 1268.28 (b) (4). 2.) Request a variance to install glass panels in the above location in violation of section 1268.28 (b) (2) A The exterior of a fence shall be constructed primarily of wood, stone, brick, wrought iron or other material determined by the Zoning Board of Appeals to mimic an above listed material. 3.) Request a variance to allow for the installation of an 8’-6” tall fence to enclose the sides of the court with the material listed in the area not allowed by ordinance 1268.28 (b) (9). 2
