STATE OF MICHIGAN COUNTY OF WAYNE TOWNSHIP OF GROSSE ILE ORDINANCE NO. 25-05 An ordinance to amend Chapter 70, Community and Traffic Transportation, Section 70-3; Chapter 205, Roads and Driveways; and Chapter 238, Subdivision Control; to update various sections related to the posting of performance guarantees by applicants for building and zoning compliance permits to make improvements to property and structures in Grosse Ile Township. The Township of Grosse Ile ordains: Section 1 of Ordinance I. The Township of Grosse Ile Code of Ordinances, Chapter 70, “Community and Traffic Transportation,” Section 70-3, “Applicability,” is hereby amended to read as follows: 70-3 Applicability. A. – E. [No change.] F. Infrastructure improvements. Where an impact statement identifies that there is not adequate infrastructure to support the proposed development, the applicant shall have the option to provide the infrastructure improvements necessary to support the proposed development or wait for the infrastructure to become adequate by improvements made pursuant to county, state or Township capital improvement programs. Approval of developments conditioned upon completion of infrastructure improvements shall be with require the posting of performance guarantees as required by in accordance with Section 285-20.5 of the Zoning Chapter Ordinance and § 238-11 of the Subdivision Control Chapter. 70-8 Review and approval procedures. Approval consideration. In approving a development, the Planning Commission and Township Board shall evaluate the project in terms of the impacts it may have on the community’s environment, socio-economic conditions, infrastructure, transportation network and fiscal conditions of the Township. Depending on the significance of the impact in each of these areas, the Planning Commission and Township Board can decide to approve the project, reject the project, or modify plans for development in such a way that impacts can be mitigated. Alternatives and project modifications shall consider measures that will mitigate the various impacts,including infrastructure improvements, scaling down the size of the project or finding a more appropriate location for the project. Performance guarantees for infrastructure improvements shall be as requiredbySection 285-20.5 oftheZoning Chapter and§ 238-11 ofthe Subdivision Control Chapter. II. The Township of Grosse Ile Code of Ordinances, Chapter 205, “Roads and Driveways,” Article 5, “Private Roads,” Section 205-19, “Application and approval procedures,” is hereby amended to read as follows: § 205-19 Application and approval procedures. The private road application and review procedure shall follow the same procedure for site plan or subdivision plats, as outlined below. The information required in this chapter shall be submitted with an application for preliminary plat, tentative, preliminary, tentative condominium, or final site plan approval. For a subdivision or condominium, the general layout of the road shall also be reviewed at the pre- preliminary plat stage. A. – D. [No change.] E. Performance guarantee. To assure completion ensure compliance with the requirements of this article and/or guarantee ongoing maintenance of a private road in accordance with the requirements set forth herein, the Township may shall require the applicant to provide a performance guarantee. The amount and form of the performance guarantee shall be determined in accordance with guidelines for fees performance guarantees provided in Chapter 285, Zoning, Article 20. F. [No change.] III. The Township of Grosse Ile Code of Ordinances, Chapter 238, “Subdivision Control,” Section 238-11, “Performance guarantee,” is hereby amended to read as follows: § 238-11 Performance guarantee. Following final approval of the preliminary plat, the proprietor applicant shall be required to deposit with the Clerk or an escrow agent cash, surety bond, or certified check, or the equivalent a performance guarantee in the form of a cash escrow in an amount approved by resolution of the Township Board, whichever the proprietor elects, to insure construction of all improvements,except where such deposits are required by Wayne County. The amount of the cash escrow deposit or bond shall be set by the Township Board based on an estimate prepared by the developer’s engineer and approved by the Township Engineer. The deposit or bond performance guarantee shall guarantee be required to ensure the completion of the required improvements within a period of time specified by the Township Board from the date of the approval of the final plat. The Township Board or escrow agent with approval of the Board shall rebate to the proprietor, as the work progresses, amounts of any cash deposits equal to the ratio of the work completed to the entire project. Section 2 of Ordinance. – Savings Clause All proceedings pending and all rights and liabilities existing, acquired, or incurred at the time this ordinance takes effect are saved and may be consummated according to the law in force when they are commenced. This ordinance shall not be construed to affect any prosecution pending or initiated before the effective date of this ordinance, or initiated after the effective date of the ordinance for an offense committed before that effective date. Section 3 of Ordinance. – Severability If any word, clause, sentence, paragraph or part of this ordinance shall be found invalid or unconstitutional by a court of competent jurisdiction, the remainder of the ordinance shall remain in full force and effect. Section 4 of Ordinance. – Effective Date; Publication The provisions of this Ordinance shall take effect as prescribed by law following publication.
