STATE OF MICHIGAN COUNTY OF WAYNE CITY OF ALLEN PARK PROPOSED #03-2026 AN ORDINANCE OF THE CITY OF ALLEN PARK CODE OF ORDINANCES; AMENDING CHAPTER 16, “ENVIRONMENT”, BY THE ADDITION OF SECTION 16-24, “NOISE CONTROL”, TO ARTICLE II, “PUBLIC NUISANCES”, TO FURTHER REGULATE NOISE IN THE CITY. The City of Allen Park Ordains: SECTION 1. Amendment to Code. That Chapter 16 “Environment”, Article II “Public Nuisances”, be amended to hereafter read as follows: Chapter 16 “Environment” Article II “Public Nuisances” Division 1 “Generally” Sec. 16-24. - Noise Control (1) Purpose and findings. (A) Purpose. The purpose of this article is to protect, preserve, and promote the health, safety, welfare, comfort, and prosperity of the citizens of the City of Allen Park through regulation of the production and emission of noises or amplified speech, music or other sounds that tend to annoy, disturb, or frighten city residents. (B) Findings. (1) The Allen Park City Council finds that inadequately controlled noise offers serious hazards to the public health, safety and welfare, and a source of annoyance to the population of the city. Unreasonably loud and disturbing noise may degrade the environment to a degree that it could: a) Be harmful to the health, welfare and safety of city inhabitants and visitors; b) Interfere with the comfortable enjoyment of life and property; and c) Interfere with the well-being, tranquility, and privacy of the home. (2) Both the effective control and elimination of unreasonably loud and disturbing noise is essential to the health and welfare of the city’s inhabitants and visitors, and to the conduct of the normal pursuits of life, including recreation, work, sleep, and communication. (3) The use of sound amplification equipment creates loud and disturbing noise that may, in a particular manner and at a particular time and place, substantially and unreasonably invade the privacy, peace, and freedom of inhabitants of, and the visitors to the city. (4) Certain short-term easing of noise restrictions is essential to allow the construction and maintenance of structures, infrastructure, and other elements necessary for the physical and commercial vitality of the city.
