NOTICE OF ADOPTION FOR CHARTER TOWNSHIP OF BROWNSTOWN ORDINANCE 141-87 AN ORDINANCE TO AMEND ORDINANCE 141-45, BY REPLACING SECTION 11.09(a), CHILD CARE CENTER, NURSERY SCHOOLS, AND DAY NURSERYS, IN ITS ENTIRETY. The Charter Township of Brownstown Ordains: Section 1: Ordinance No. 141-45, “ZONING ORDINANCE”, Section 11.09(a) “Child Care Center, Nursery Schools and Day Nurseries” shall now provide: (1) An outdoor play area shall be provided, equipped and maintained, on the premises in accordance with the applicable licensing requirements of the State of Michigan. As a guideline for site design, the State of Michigan’s Technical Assistance Manual recommends, as a best practice, that the outdoor play area be designed to accommodate at least one-third (1/3) of the licensed capacity at one time, with a minimum of seventy-five (75) square feet of usable outdoor play area per child using the outdoor play area at one time. (2) The outdoor play area shall be suitably fenced and screened from any Residential District or use by a Buffer Zone Type C in accordance with Section 14.02 Landscaping. (3) Upon issuance, the applicant shall provide the Township with a copy of the applicable child care license issued by the State of Michigan. Section 2. Severability. If any article, section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity of such article, section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance. Section 3. Repealer. All ordinances, resolutions or orders, or parts of ordinances in conflict with the provisions of this Ordinance to the extent of such conflict, are hereby repealed. Section 4. Effective Date; Publication. This Ordinance was approved and adopted by the Township Board of Brownstown Charter Township, Wayne County, Michigan, on August 17, 2026, after introduction and a first reading on July 20, 2026, and publication after first reading as required by Act 359 of the Michigan Public Acts of 1947, as amended. This Ordinance shall be effective seven (7) days after publication of a “Notice of Adoption”, in The News Herald, a newspaper having general circulation in the Township. I further certify that the foregoing was published in The News Herald, a newspaper of general circulation in the Charter Township of Brownstown, on the 23 rd day of August, 2026.
