STATE OF MICHIGAN COUNTY OF WAYNE CITY OF ALLEN PARK PROPOSED ORDINANCE #02-2026 AN ORDINANCE OF THE CITY OF ALLEN PARK CODE OF ORDINANCES; AMENDING CHAPTER 2, “ADMINISTRATION”, BY THE REPEAL AND READOPTION OF SECTIONS 2-110, 2-111 AND 2-113 OF CHAPTER 2 “ADMINISTRATION”, ARTICLE III. OFFICERS, OFFICIALS AND EMPLOYEES, SUBDIVISION II BOARD OF ETHICS TO REMOVE THE ONE TERM LIMITATION FOR BOARD MEMBERS, REMOVE THE MEMBERSHIP ON A COMMISSION OF ANY GOVENMENTAL BODY OR AGENCY OTHER THAN THE CITY PROHIBITION AND REMOVE THE ONE TERM LIMITATION FOR THE CHAIRPERSON. The City of Allen Park Ordains: SECTION 1. Amendment to Code. That Sections 2-110, 2-111 and 2-113 of Chapter 2 “Administration”, Article III. Officers, Officials and Employees, Subdivision II Board of Ethics be repealed and readopted to hereafter read as follows: Sec. 2-110. - Composition; term of members. The board of ethics shall consist of five members. Members shall be nominated, within 30 days of a vacancy, by the mayor and approved by the council as provided for in article VII of the Charter. Of the members first appointed, one member each shall be appointed for a term of one year, two years, three years, four years and five years. Thereafter, each member shall serve for a term of five years. Sec. 2-111. - Eligibility for appointment. No person shall be eligible for appointment who: (1) Is an elected or appointed officer or employee of the city; or (2) Is a member of any other board or commission of the city. Sec. 2-113. - Organization. (a) The board shall have a minimum of a chairperson and a vice-chairperson. The board member serving their last year of appointment shall be the chairperson for that year. The board member serving their next to the last year of appointment shall be the vice-chairperson for the same year. (b) Should either one or both of the members serving in these positions not complete their full term of office, their successor shall not assume the vacated position. In the event of a vacancy in the position of chairperson, vice-chairperson shall become the acting chairperson for the balance of the term of office and then shall become the chairperson for the successive term of office. In the event of a vacancy in the position of vice-chairperson, the next board member with the most seniority shall become the vice-chairperson for the balance of the term of office and for the successive term of office. (c) The board shall adopt such other rules of procedure as are necessary and are not inconsistent with this article, other city ordinances and other laws of the state and federal government.
