ORDINANCE NO. 30- 1090 THE CITY OF WARREN AMENDED THE CODE OF ZONING ORDINANCES TO ADD OVERLAY DISTRICTS TO STIMULATE RESIDENTIAL AND COMMERCIAL DEVELOPMENT The Code of Zoning Ordinances of the City of Warren was amended to add an article establishing overlay zoning districts. An overlay is a zoning district that overlaps an existing zoning district for the purpose of creating special development standards. The initial adoption of the ordinance on June 9, 2026, encompassed an initial two separate overlay districts; the Missing Middle District, which addresses housing development, and the Van Dyke Mixed Use District, which addresses mixed-use development, primarily along the Van Dyke Corridor. 1) Missing Middle Overlay District – intended to promote residential housing and density within the area of Eight Mile Road and Stephens Road from Sherwood Avenue to Beechwood Drive, Warren, Michigan, in districts currently zoned as R-1-C (One-Family Residential District), R-1-P (One Family Parking District), R-2 (Two-Family Residential District), and R-3 (Multiple-Family Residential District). The Missing Middle overlay district development standards include: • two-family, three-family, and four-family dwellings are allowed in areas historically limited to single-family housing; • new setback requirements are established; including a reduction to front setbacks from 25 feet to 15 feet, or the average of five adjacent setbacks, no lower than 10 feet. The rear yard setback is reduced from 35 to 20 feet; • Side yard to 10 combined feet; • Building height is increased from two stories to two and one-half stories • Garages are permitted within rear yard setback areas; • The ordinance allows for administrative review of plans and minor adjustments to setbacks for limited situations. 2) Van Dyke Mixed Use District – pertains to commercial redevelopment, primarily within the Van Dyke Corridor, generally extending from Stephens Road to Eight Mile Road. 350 feet east and west of the centerline of Van Dyke Avenue. At the Nine Mile intersection, it includes the entire area bordered by Automobile Street on the east, Dodge Street on the south, Peters Street on the west, and Paige Street on the north. At Eight Mile Road, it includes the area from the centerline of Eight Mile on the south, to Winfield Street on the west, Rivard Street on the north, and Ascension Street on the east. The Van Dyke Mixed Use District overlay development standards include: • zero front foot setback to promote pedestrian-oriented development and an active streetscape along Van Dyke Avenue; • permitted areas for outdoor cafes, planters and decorative fencing, and other streetscape elements; • increase height to 48 feet or four stories, whichever is less; • expanding range of permitted businesses. The ordinance shall take effect on July 10, 2026.
