CHARTER TOWNSHIP OF BROWNSTOWN WAYNE COUNTY, MICHIGAN ORDINANCE NO. 141-84 AN ORDINANCE TO AMEND ORDINANCE 141-45, SECTIONS 13.01(a)(3),13.01(a)(6)(b), AND ADDING SECTIONS 13.01(a)(9), AND SECTION 13.12 The Charter Township of Brownstown Ordains: Section 1: Ordinance No. 141-45, “ZONING ORDINANCE”, Section 13.01(a)(3) shall now provide: (3) Accessory buildings, structures, and uses shall not be located within a dedicated easement or right-of-way: except that an accessory building up to 200 square feet in area may be allowed in a dedicated easement provided said building does not have a permanent foundation and the property owner submits an executed easement awareness form. Section 2: Ordinance No. 141-45, “ZONING ORDINANCE”, Section 13.01(a)(6)(b) shall now provide: b. 150% of the ground floor area of the principal building for properties with 20,000 square feet of lot area or more, but less than one acre; and Section 3: Ordinance No. 141-45, “ZONING ORDINANCE”, Section 13.01(a)(9) shall now provide: (9) Shipping containers shall be prohibited in residential zoning districts. Section 4: Ordinance No. 141-45, “ZONING ORDINANCE”, Section 13.12 shall now provide: Section 13.12 Portable Temporary Storage Containers. Portable temporary storage containers may be delivered, placed and used temporarily in any zoning district in accordance with provisions of this section. (a) Temporary Loading and Unloading (1) Such containers may be temporarily placed on a property to store goods, items or objects that are being moved to another location or that are being stored during building remodeling or for other purposes, provided they shall only be used to store personal goods and property associated with the property on which the container is placed. (2) No more than one (1) such container may be used on a residentially zoned or used property at any given time. Up to three (3) such containers may be used on non-residentially zoned land. (3) Such containers shall be placed on a hard surface or in a non-required side or rear yard of an occupied lot and shall not be located in an easement or right-of-way, nor shall it block a sidewalk or pathway. (4) The maximum duration for use of such container(s) shall be thirty (30) days during a calendar year. The Community Services Department may grant one extension of up to an additional thirty (30) days. In doing so, the Department may require safeguards including, but not limited to, setbacks, screening and off-street parking in order to protect the public health, safety and welfare (5) Use of such container shall require approval from the Community Services Department prior to delivery of such container to the subject property. (6) Such containers shall be used and maintained in a manner that does not disturb the public health, safety or welfare. (7) Such containers shall not be used to store toxic or hazardous materials as designated by the Michigan Fire Code. (8) Use of such containers for a period of no more than forty-eight (48) hours shall not require Township approval. (b) Use on Construction Sites (1) Temporary use of a storage container is allowed on construction sites with a current building permit for the work requiring the need for such container. (2) The storage container shall be removed upon completion of the work authorized by the building permit, or when the permit expires, whichever occurs first. Section 5. Severability. If any article, section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity of such article, section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance. Section 6. Repealer. All ordinances, resolutions or orders, or parts of ordinances in conflict with the provisions of this Ordinance to the extent of such conflict, are hereby repealed. 1st Reading Township Board approved on April 6, 2026. 2nd Reading to be adopted by the Township Board on May 4, 2026.
