TOWNSHIP OF MACOMB MACOMB COUNTY, MICHIGAN ORDINANCE NO. 317 THE TOWNSHIP OF MACOMB ORDAINS: Section 1. Chapter 12 – Offenses, Article IX – Offenses Against Minors, is hereby amended by renaming Article IX to be “Offenses Against Underage Persons.” Section 2. Chapter 12 – Offenses, Article IX – Offenses Against Underage Persons, is hereby amended by adopting Division 4 – House Parties, to provide as follows: DIVISION 4. – HOUSE PARTIES Sec. 12.461 – Definitions. Alcoholic beverage means any beverage containing more than one-half of one percent of alcohol by volume. The percentage of alcohol by volume shall be determined in accordance with the provisions of MCL 436.1105, MSA 18.1175(105). Control means any form of regulation or dominion, including a possessory right. Drug means a controlled substance as defined now or hereafter by the Public Acts of the state. Currently, such controlled substances are defined by MCL 333.7101-333.7545, MSA 14.15(7101)-14.15(7545). House party means a social gathering of persons at a residence, other than the owner, tenant, land contract vendee or their immediate family members. Residence means a home, apartment, condominium or other dwelling unit, and including the curtilage of such dwelling unit. Underage person means a person not legally permitted by reason of age to possess alcoholic beverages pursuant to MCL 436.1703, MSA 18.1175(703). Sec. 12.462 – Prohibition. 1. Underage persons possessing and consuming alcohol and drugs. No person having control of any residence shall allow a house party to take place at their residence if any alcoholic beverages or drug is possessed or consumed at such residence by any underage person where: (1) Person responsible knew. The person having control of the residence knew or reasonably should have known that an alcoholic beverage or drug was in the possession of or being consumed by an underage person at the residence; and (2) Person responsible failed to prevent. The person having control of the residence failed to take reasonable steps to prevent the possession or consumption of the alcohol beverage or drug at the residence. 2. Religious observances excluded. The provisions of this section shall not apply to legally protected religious observances. Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith are repealed only to the extent necessary to give this Ordinance full force and effect. Section 4. Severability. This Ordinance is declared to be severable. If any part, section, subsection, provision, sentence, or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, it is declared that the remainder shall not be affected thereby. Section 5. Effective Date. This amendment to the Macomb Township Code of Ordinances shall become effective 30 days after its publication. NOW THEREFORE, BE IT RESOLVED that Macomb Township Board of Trustees does hereby authorize the Supervisor to enroll Macomb Township as a participant in the State of Michigan’s new Opioid Settlement.
