CHARTER TOWNSHIP OF BROWNSTOWN WAYNE COUNTY, MICHIGAN ORDINANCE NO. 141- 83 AN ORDINANCE TO AMEND ORDINANCE 141-45, BY REPLACING SECTION 11.05(a), AUTOMOBILE FILLING/SERVICE STATION, IN ITS ENTIRETY. The Charter Township of Brownstown Ordains: Section 1: Ordinance No. 141-45, “ZONING ORDINANCE”, Sections 11.05(a) “Automobile Filling/Service Station”, shall now provide: (a) Automobile Filling/Service Station (1) Minimum lot width shall be one hundred and fifty (150) feet. (2) The site shall have its primary access to/from a Major Road, as defined in Section 25.10(g). (3) A traffic impact study, in accordance with Section 17.09, shall be provided. (4) No new automobile filling/service station shall be located closer than 1,500 feet from another filling/service station. This measurement shall be made in a straight line from the nearest point on the lot line of the property where the filling/service station is proposed, to the nearest lot line of any other existing or proposed filling/service station. This standard shall not apply to improvement/expansion proposed for an existing filling/service station. Additionally, accessory filling/service stations as part of a large retail establishment that contain a minimum of 100,000 square feet of gross floor area shall be exempt from this standard. (5) A buffer zone, in accordance with Section 14.02(f), shall be provided along all lot lines that abut residential zoning or land use. (6) All underground fuel storage tanks shall be located a minimum of one hundred fifty (150) feet from residential zoning or land use. (7) Unless a greater setback is required by the particular zoning district, an automobile service station building and fuel pump canopies shall be located not less than forty (40) feet from any right-of-way line and not less than fifty (50) feet from any side or rear lot line. (8) Ingress and egress drives shall not be more than thirty (30) feet in width, unless otherwise authorized by MDOT or Wayne County. (9) Only one (1) curb opening shall be permitted along any road. All drive or curb openings shall meet the access standards of Section 15.05 Driveway Access Management. (10) A raised curb of six (6) inches in height shall be constructed along all road frontages at the right-of-way line, except for drive openings, in such areas where public roads meet the same standard. (11) The entire lot, excluding the area occupied by a building, shall be hard-surfaced with concrete or a plant-mixed bituminous material except desirable landscaped areas which shall be separated from all paved areas by a low barrier or curb. (12) The design and materials of the canopy shall be compatible with the principal building. The proposed clearance of any canopy shall be noted on the site plan. Any signs, logo or identifying paint scheme on the canopy shall be reviewed by the Planning Commission and considered part of the maximum wall sign permitted. Details on the canopy lighting shall be provided to ensure there is no glare on the public roads or adjacent property, and that lighting levels are in accordance with Section 14.04 Lighting. Canopy lighting shall be recessed such that the light source cannot be seen from off-site. (13) There shall be no outdoor storage or display of vehicle components and parts, supplies, or equipment or other merchandise, except within an area defined on the site plan approved by the Planning Commission and which extends no more than ten (10) feet beyond the building. (14) Any vehicle maintenance shall be reviewed separately, in accordance with the requirements of subsection (b) below. Section 2. Severability. If any article, section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity of such article, section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance. Section 3. Repealer. All ordinances, resolutions or orders, or parts of ordinances in conflict with the provisions of this Ordinance to the extent of such conflict, are hereby repealed. 1st Reading Township Board approved on April 6, 2026. 2nd Reading to be adopted by the Township Board on May 4, 2026.
