CITY OF LAKE ANGELUS NOTICE OF ADOPTION ZONING ORDINANCE TEXT AMENDMENT ORDINANCE NO. 171 On December 9, 2025, the City of Lake Angelus City Council adopted a text amendment amending; Chapter 1242 - Planning and Zoning Code of the Code of Ordinances to renumber Section 1242.01, “Building Official” to be sequential, and to add a new subsection 1242.04 (f) entitled “Review Authority.” Sec. 1242.02. – Authority of Building Official [Unchanged.] Sec. 1242.04. – Site Plan Review (a) - (e) [Unchanged.] (f) Review Authority. In order to streamline the site plan and development review process while maintaining consistency with the intent and purpose of this Zoning Code, the City establishes a three-level system of review based on the scope and potential impact of the proposed changes: (1) Major Site Plan Review (Planning Commission Review). Major site plans or amendments shall be reviewed and acted upon by the Planning Commission. These include: A. New principal structures or additions resulting in an increased building footprint of 200 square feet or more; B. Any project that materially alters grading, drainage, or the natural character of the site; C. Projects that involve significant vegetation removal or modifications to lakeside or roadside preservation areas; D. Any use requiring a special land use permit or variance; E. Any application referred to the Planning Commission by the Building Official or Administrative Advisory Group due to complexity, policy impact, or public interest; F. Any change that alters a condition of site plan approval as approved by the Planning Commission. (2) Administrative Review (Administrative Advisory Group). The Administrative Advisory Group, consisting of the Building Official, Planning Consultant, and one designated Planning Commission member, may review and act upon site plan modifications that are limited in scope but exceed the criteria for minor changes. Any action by the Administrative Review Group shall be noted on the approved site plan. These include: A. Additions or accessory structures resulting in an increase of 200 feet or more of floor area within the existing building footprint; 2 B. Tree removal or replacement plans that comply with the intent of Section 1258.11; C. Modifications to approved site plans that do not alter approved setbacks, height, or drainage patterns; D. Relocation of accessory items such as HVAC units, generators, or mechanical equipment; E. Landscape, lighting, or driveway modifications consistent with ordinance standards. F. The Administrative Advisory Group may refer any application to the Planning Commission if it determines the request may have broader community impact. (3) Minor Changes (Building Official Review). The Building Official may review and approve minor changes or modifications to previously approved site plans when such changes do not materially alter the intent or conditions of approval. Examples include: A. Adjustments in building materials, window placement, or architectural detailing; B. Replacement of vegetation in kind consistent with approved landscape plans; C. Minor grading adjustments that do not affect drainage, setback, or tree protection areas. D. The Building Official shall provide a record of all administrative approvals to the Planning Commission for informational purposes and add any administrative approvals to the approved site plan. (4) Appeals and Oversight. Any applicant or property owner aggrieved by a determination under Section (f) may request Planning Commission review within thirty (30) days of the decision. The Planning Commission retains final authority to interpret this section and resolve disputes regarding the proper tier of review.
