CHARTER TOWNSHIP OF BROWNSTOWN WAYNE COUNTY, MICHIGAN ORDINANCE NO. 281-4 AN ORDINANCE TO AMEND PART 254 (“DOWNTOWN DEVELOPMENT PLAN”), TO INCLUDE ADDITIONAL DEFINITIONS, TO ADOPT AND APPROVE THE 2025 PLAN AMENDMENT, AND TO PROVIDE FOR REPEALER, SEVERABILITY, AND EFFECTIVE DATE. The Charter Township of Brownstown ordains: Section 1. Brownstown Ordinance No. 254.001 is hereby amended by including the following definition: “2025 Plan Amendment” means the amendment to the Tax Increment Financing Plan for the Charter Township of Brownstown Downtown Development Authority District, including the Development Plan adopted by the Authority, that relates to the Recreation Campus and which was approved pursuant to this ordinance, copies of which are on file in the office of the Clerk of the Charter Township of Brownstown. Section 2. Brownstown Ordinance 254.002 is hereby amended by including the following: Sec. 2(C).The Township previously created the Authority pursuant to Ordinance No. 280. The Township previously approved the Original Plan pursuant to Ordinance No. 281, and subsequent Plan Amendments and other amendments to Ordinance No. 281. The Authority approved and submitted the 2025 Plan Amendment to the Township Board of Trustees pursuant to the provisions of Act 57 of 2018. The Township Board of Trustees conducted a public hearing on the proposed 2025 Plan Amendment, with notice thereof given in accordance with all laws, including Act 57 of 2018, has complied with other procedural requirements contained in Act 57, has reviewed the proposed 2025 Plan Amendment, and desires to approve the proposed 2025 Plan Amendment. Pursuant to Section 219 of Act 57 of 2018, the Township Board of Trustees of the Charter Township of Brownstown, Wayne County, Michigan, hereby finds and determines in accordance with Section 219 of Act 57 of 2018 as follows: (a) That the Development Plan and Tax Increment Financing Plan, as amended by the 2025 Plan Amendment, constitutes and embodies a public purpose of the Charter Township of Brownstown; (b) That the Development Plan and Tax Increment Financing Plan, as amended by the 2025 Plan Amendment, meets the requirements set forth in Sections 217(2) of Act 57 of 2018; (c) That the proposed method of financing the development activities described in the Development Plan and Tax Increment Financing Plan, as amended (including amendments made pursuant to the 2025 Plan Amendment), is feasible, and that the Downtown Development Authority has the ability to arrange the financing; (d) That the development activities described in the Development Plan and Tax Increment Financing Plan, as amended (including amendments made pursuant to the 2025 Plan Amendment), are reasonable and necessary to carry out the purposes of Act 57 of 2018; (e) That the land to be acquired within the Downtown Development Authority District is reasonably necessary to carry out the purposes of the Development Plan and Tax Increment Financing Plan, as amended (including amendments made pursuant to the 2025 Plan Amendment), and the purposes of Act 57 of 2018; (f) That the Development Plan and Tax Increment Financing Plan, as amended (including amendments made pursuant to the 2025 Plan Amendment), is in reasonable accord with the approved Master Plan of the Charter Township of Brownstown; (g) That public services, such as fire and police protection and utilities are, or will be, adequate to service the Downtown Development Authority District; and (h) That such changes in zoning, streets, street levels, intersections, and utilities as are contemplated by the Development Plan and Tax Increment Financing Plan, as amended (including amendments made pursuant to the 2025 Plan Amendment), are reasonably necessary for the Project. Based upon the foregoing consideration, the Township Board of Trustees hereby determines that it is in the best interest of the health and welfare of the Township, and necessary for the achievement of the purposes of Act 57 of 2018, to adopt the 2025 Plan Amendment as proposed. The Township Board of Trustees further determines that, upon review of the 2025 Plan Amendment, that the Downtown Development Authority Development Plan and Tax Increment Financing Plan as amended by the 2025 Plan Amendment constitute a public purpose, and that it is in the best interests of the public to proceed with the Downtown Development Authority Development Plan and Tax Increment Financing Plan as amended by the 2025 Plan Amendment in order to prevent and halt property value deterioration, to increase property tax valuation, to eliminate the causes of deterioration in property values, and to promote growth in the Downtown Development Authority District. In accordance with the foregoing considerations, the 2025 Plan Amendment, and the Downtown Development Authority Development Plan and Tax Increment Financing Plan as amended (including amendments made pursuant to the 2025 Plan Amendment), are hereby approved and adopted for all purposes of Act 57 of 2018 consistent with said plans. A copy of the Development Plan and Tax Increment Financing Plan, as amended (including amendments made pursuant to the 2025 Plan Amendment), and all other respective amendments thereto, shall be maintained on file in the Township Clerk’s office and cross-indexed to this Ordinance. Section 3. Repealer. All ordinances, resolutions or orders, or parts of ordinances in conflict with the provisions of this Ordinance to the extent of such conflict, are hereby repealed. Section 4. Severability. The various sections and provisions of this Ordinance shall be deemed to be severable; and should any section or provision of this Ordinance be declared by any court of competent jurisdiction to be unconstitutional or invalid, the same shall not affect the validity of the Ordinance as a whole or any section or provision of this Ordinance other than the section or provision so declared to be unconstitutional or invalid. Section 5. Effective date; publication. This Ordinance was approved and adopted by the Township Board of Brownstown Charter Township, Wayne County, Michigan, on October 20, 2025, after introduction and a first reading on September 15, 2025, and publication after first reading as required by Act 359 of the Michigan Public Acts of 1947, as amended. This Ordinance shall be effective immediately upon publication, in The News Herald, a newspaper having general circulation in the Township.
