Maple requests the following variances to construct a new 6-10 story mixed-use building in the Triangle District of Birmingham: A. Chapter 126, Article 3, Section 3.08(C) of the Zoning Ordinance requires new buildings in the MU5 zoning district to be constructed to a height of no more than 66 feet. The proposed overall building height in the MU5 portion of the site is 69.0 feet. Therefore, a variance of 3.0 feet is being requested in the MU5 portion of the site. B. Chapter 126, Article 3, Section 3.08(C) of the Zoning Ordinance requires new buildings in the MU5 zoning district to be constructed to no more than 5 stories. The proposed building is 6.0 stories in the MU5 portion of the site. Therefore, a variance of 1.0 story is being requested in the MU5 portion of the site. C. Chapter 126, Article 3, Section 3.08(D) of the Zoning Ordinance requires new buildings in the MU7 zoning district to be constructed to a height of no more than 114 feet and 9 stories if the bonus height requirements of Section 3.08(E) are met. The applicant has met the requirements of Section 3.08(E). The proposed overall building height is 111 feet and 10 stories. Therefore, a variance of 1.0 story is being requested. Appeal No. 26-16: The owner of the property known as 214 W Maple requests the following variance to install a new wall sign on an existing building in Downtown Birmingham: A. Chapter 86, Article 1, Section 1.05(K) of the Birmingham Code of Ordinances (Sign Ordinance) requires wall signs to not extend beyond the first floor sign band. The proposed wall sign is proposed to be placed on a window 2 feet 3 inches below the sign band. Therefore, a variance of 2 feet 3 inches is being requested. Appeal No. 26-15: The owner of the property known as 1573 Chesterfield, requests the following variance to construct a new home with an attached garage on a corner lot: A. Chapter 126, Article 4, Section 4.61 (A) 1 of the Zoning Ordinance requires a corner lot which has on its side street an abutting interior residential lot shall have a minimum setback from the side street equal to the minimum front setback for the zoning district in which such building is located. This requirement shall not reduce the buildable width of any lot to less than 25 feet.
