CHARTER TOWNSHIP OF BROWNSTOWN WAYNE COUNTY, MICHIGAN ORDINANCE NO. 141-86 AN ORDINANCE TO AMEND ORDINANCE 141-45 BY AMENDING SCHEDULE OF USES TABLE NO 3.02 (15) (SHORT TERM RENTAL), AND RENUMBERING SUBSEQUENT USES, BY ADDING SECTION 11.06(C) (SHORT TERM RENTAL), AND RELETTERING SUBSEQUENT SUBSECTIONS, BY AMENDING TABLE 15.01.B TO INCLUDE SHORT TERM RENTAL, BY AMENDING SECTION 25.07(E) TO ADD A DEFINITION FOR “LOCAL AGENT”, AND RELETTERING THE SUBSEQUENT DEFINITION, AND BY AMENDING SECTION 25.11(I) TO INCLUDE A DEFINITION FOR “SHORT TERM RENTAL”, AND TO RELETTER SUBSEQUENT DEFINITIONS THEREIN. The Charter Township of Brownstown Ordains: Section 1. Ordinance No. 141-45, “ZONING ORDINANCE”, Table 3.02 is hereby amended to include: 15. Short Term Rental SLU SLU SLU SLU Section 11.06(c) And to re-number current uses “15” through “28” to “16” through “29”, respectively. Section 2. Ordinance No. 141-45, “ZONING ORDINANCE”, Section 11.06 (c), shall now provide: Short Term Rentals 1. Registration shall be required through the Community Services Department according to Section 241.004 Registration of the Rental Registration Ordinance. 2. Short-term rental units shall require an annual inspection as set forth in the Township’s Property Maintenance Code and according to Section 241.005 Inspections of the Rental Registration Ordinance. 3. A certificate of compliance shall be required in accordance with Section 241.006 Certificate of Compliance of the Rental Registration Ordinance. 4. The short-term rental must be operated entirely within the principal dwelling and not within any garage or accessory building located upon the premises. This includes the parking requirement of Section 15.01 of this Ordinance. 5. Placement of recreational vehicles or tents on the premises shall not be permitted for occupancy as a short-term rental. 6. The short-term rental shall not have any exterior evidence, other than a permitted sign in accordance with the standards for home occupants set forth in Section 16.05(a) of the Zoning Ordinance, to indicate that the residence is being utilized for any purpose other than that of a dwelling. 7. The use of the short-term rental shall not involve any alteration or construction not customarily associated with a single-family detached dwelling. 8. The short-term rental shall adhere to the conditions contained elsewhere in this Code related to noise, smoke, odor, light pollution, and other nuisances, and the rental shall meet all applicable local, county, state, and federal safety, fire, and health standards. 9. The short-term rental shall be limited only to the tenant(s) renting the property at a given time. Short-term rentals shall not be permitted for use outside of the provisions of this section, such as event venues, dining facilities, or the production or provision of goods or services. 10. Each bedroom shall be designed for sleeping and meet building code requirements, including emergency egress. 11. All operations shall maintain a guest register, either on the premises or electronically, and all guests shall be legibly registered. 12. A landscape buffer zone C, in accordance with Section 14.02(f) of this Ordinance, shall be provided along all side and rear lot lines. 13. A site plan, including a floor plan, shall be submitted for approval. 14. All parking spaces, including any for recreational vehicles, shall be provided on the parcel they are intended to serve and on a hard surface (concrete or asphalt). 15. Each short-term rental shall have a local agent as the primary contact on file with the Township (Department of Community Services). The local agent shall live or maintain a physical place of business within twenty (20) miles of the dwelling unit used for short-term rentals. A property owner who meets these criteria may be the local agent. The owner shall provide the Township with contact information for the local agent and keep an updated copy of the local agent contact information with the Township. 16. A safety information sheet shall be provided regarding fire exits, available tornado shelter, the address of the property, and a local contact must be posted on the back of each sleeping unit door and exit. This shall be designated on the floorplan. 17. A minimum of two exits shall be provided. These exits shall be clearly designated on the floorplan and physically identified as such by means of a placard, sign, or similar highly visible feature. 18. Smoke detectors/fire alarms and carbon monoxide detectors shall be interconnected at a minimum of one per floor. In addition, one smoke detector or fire alarm shall be installed in each sleeping unit. 19. The applicant shall provide proof of insurance. The policyholder shall ensure that there is no lapse in coverage between the date of policy issuance and issuance of the short-term rental license, if the dates differ. And re-letter subsequent subsections. Section 3. Ordinance No. 141-45, “ZONING ORDINANCE”, Table 15.01.b is hereby amended to include: Short Term Rental 2 spaces plus 1 space per bedroom Section 4. Ordinance No. 141-45, “ZONING ORDINANCE”, Section 25.07 (e) shall now provide: (e) Local Agent. An individual designated to oversee a short-term rental and to respond to calls from renters and representatives of the Township. And re-letter current subsection “(e)” to “(f)”. Section 5. Ordinance No. 141-45, “ZONING ORDINANCE”, Section 25.11(i) shall now provide: (i) Short Term Rental. A single-family detached dwelling rented on a daily, weekly, or other basis for less than 30 days per rental period. The term short-term rental does not include a bed and breakfast inn, hotel, or motel. And re-letter current subsection “(i)” and “(j)” to “(j)” and “(k)”. Section 6. Severability. If any article, section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity of such article, section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance. Section 7. Repealer. All ordinances, resolutions or orders, or parts of ordinances in conflict with the provisions of this Ordinance to the extent of such conflict, are hereby repealed. 1st Reading Township Board approved on June 15, 2026. 2nd Reading to be adopted by the Township Board on July 20, 2026.
