STATE OF MICHIGAN COUNTY OF WAYNE CITY OF ALLEN PARK proposed ordinance #09-2025 AN ORDINANCE OF THE CITY OF ALLEN PARK CODE OF ORDINANCES; AMENDING CHAPTER 26, “OFFENSES”, ARTICLE VI, “OFFENSES AGAINST PUBLIC MORALS”, DIVISION 1, “GENERALLY”, BY THE ADOPTION OF SECTION 26-264, “OPEN ALCOHOL IN PUBLIC PLACES”, TO PROHIBIT THE POSSESSION OR CONSUMPTION OF OPEN ALCOHOL IN PUBLIC PLACES. The City of Allen Park Ordains: SECTION 1. Amendment to Code. That Section 26-264, “Open Alcohol in Public Places” is hereby adopted and added to Chapter 26, “Offenses”, Article VI, “Offenses Against Public Morals”, Division 1, “Generally”, to hereafter read as follows: Chapter 26, Offenses Article VI, Offenses Against Public Morals Division 1, Generally Sec. 26-264. – Open Alcohol in Public Places. (a) No person shall possess or consume any alcoholic beverage, including liquor, beer, wine or any other intoxicating beverage, in a container which is open, uncapped, or upon which the seal is broken, in any public place, or place open to the public, unless the place is licensed to sell alcoholic beverages for consumption on the premises. (b) This section shall not apply to an area established by the city as a “Social District”, a designated festival area, or the city’s annual Street Fair, where alcohol consumption is permitted in the area designated and operated by licensed vendors and establishments.
