MOTION BY: Dionne SUPPORTED BY: Terenzi TO ADOPT THE FOLLOWING ORDINANCE, AN AMENDMENT TO SEC. 82-35 CHANGING THE DUE DATE FOR PAYMENT OF WATER BILLS, AND TO PROVIDE FOR REPEALER, SEVERABILTY AND EFFECTIVE DATE. CITY OF UTICA MACOMB COUNTY, MICHIGAN ORDINANCE NO.186 THE CITY OF UTICA ORDAINS: Section 1. Preamble. In order to protect public health, safety and welfare, the City of Utica (“City”) is desirous of enacting the following ordinance: Section 2. The Code of Ordinances for the City of Utica, Chapter 82 – Utilities, Sec. 82-35, is hereby amended to read as follows: Sec. 82-35. Billing. All metered customers of the system shall be billed monthly. All bills are to be paid by the 14th day of the month following issuance of the bill, including weekends and holidays, and an additional ten percent will be added to the amount of the bill if not paid as provided herein. Water shall be shut off if not paid within 90 days of the date due. Water so shut off shall not be turned on again until a turn-on charge in the amount established by council, plus all sums due and owing are paid in full. Section 3. Repealer. All ordinances or parts of ordinances in conflict herewith are repealed only to the extent necessary give this ordinance full force and effect. Section 4. Severability. If any article, section, subsection, sentence, clause, phrase, portion of this ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of remaining portions of the ordinance, it being the intent of the City that this ordinance shall be fully severable. Section 5. Effective Date. The ordinance shall become effective upon adoption and publication.
