VILLAGE OF FRANKLIN OAKLAND COUNTY, MICHIGAN ZONING/SIGN BOARD OF APPEALS NOTICE OF PUBLIC HEARING Village of Franklin Hall (Broughton House), 32325 Franklin Road, Franklin, MI, 48025 Thursday, November 20, 2025, at 7:00 PM Zoning Board of Appeals Case #25-006 Parcel #: TF-24-08-177-034 Property: 30542 Hickory Lane Zoning: R-1 Description of Request: Inground Pool Status: The existing house is currently in the process of being remodeled with an addition. The house is on a large parcel of land. The current inground pool has been determined to be in such state that repairs are not feasible. The plumbing pipes and connections to the pool structure are deteriorated beyond repair. The current pool is not useable as it exists and is requested to be replaced. Village of Franklin ordinance 1268.13 (b) does not allow for an accessory structure to be located where the current existing non-conforming pool is located (in a defined side yard). Ordinance 1250.04 (g) includes swimming pools as an accessory structure. There is a violation of the ordinance per the proposed site plan. Section 1268.13 (b) An accessory building shall be in the rear yard except when structurally attached to the main building. The above pool is in a side yard therefore in violation of the above ordinance. The applicant is requesting a variance to locate a replacement inground pool in the south side yard. The plans for the variance requested are available for viewing in the Village Clerk’s office during normal business hours; Monday through Friday from 9:00 AM to 5:00 PM.
